ARMTED COPYRIGHT AND INTELLECTUAL PROPERTY POLICY

1. ABOUT THIS POLICY

This Copyright and Intellectual Property Policy (“IP Policy”) explains how ARMTED handles claims concerning copyright, trademarks and other intellectual property rights in connection with the ARMTED platform and services.

ARMTED respects intellectual property rights and expects users of the platform to do the same.

This IP Policy supplements the ARMTED Terms of Service, Community Guidelines and other applicable ARMTED policies.

2. SCOPE OF THIS POLICY

This Policy applies to intellectual property issues involving content available through ARMTED, including, where applicable:

  • posts;
  • photographs;
  • videos;
  • graphics;
  • illustrations;
  • descriptions;
  • comments;
  • profiles;
  • listings;
  • firearm and product information;
  • event content;
  • business profiles;
  • logos;
  • trademarks;
  • advertising and sponsored content;
  • catalogue content;
  • documents;
  • other user-generated content; and
  • other materials made available through ARMTED.

This Policy may apply to claims concerning:

  • copyright;
  • related or neighbouring rights;
  • trademarks;
  • trade names;
  • protected logos;
  • design rights;
  • database rights; and
  • other intellectual property rights recognised by applicable law.

3. USER RESPONSIBILITY FOR CONTENT

Users may only upload, publish, submit or otherwise make available content that they have the right to use.

By providing content through ARMTED, you represent that you have all rights, licences, permissions and authorisations necessary to provide that content and to grant ARMTED the rights provided for in the ARMTED Terms of Service.

You must not upload or publish content merely because it is available elsewhere on the Internet.

The fact that a photograph, video, description, graphic or other material is publicly accessible does not necessarily mean that it is free to use, reproduce, modify or distribute.

Users are responsible for assessing whether they have sufficient rights to the content they provide.

4. USER CONTENT AND ARMTED’S LICENCE

Users retain the intellectual property rights they hold in content they submit to ARMTED, subject to the rights and licences granted under the ARMTED Terms of Service.

When a user provides content to ARMTED, the licences granted under the Terms of Service may allow ARMTED to host, store, reproduce, process, adapt, display, distribute, communicate, promote and otherwise use that content for purposes permitted by those Terms.

This may include, where permitted under the Terms of Service, using eligible user content in connection with:

  • operating ARMTED;
  • displaying content through ARMTED;
  • providing ARMTED functionality;
  • distributing and recommending content;
  • promoting content within ARMTED;
  • promoting ARMTED itself;
  • marketing and advertising ARMTED services; and
  • presenting ARMTED through websites, applications, social media, promotional materials and other communication channels.

Submitting an intellectual property complaint does not automatically revoke or otherwise modify licences previously granted to ARMTED by the person who submitted the relevant content.

The scope, duration and termination of licences granted to ARMTED are governed by the ARMTED Terms of Service.

5. ARMTED INTELLECTUAL PROPERTY

The ARMTED platform contains intellectual property owned by or licensed to Integral Dot sp. z o.o.

Depending on the relevant material, this may include:

  • the ARMTED name;
  • ARMTED trademarks and logos;
  • software;
  • source and object code;
  • platform architecture;
  • user interfaces;
  • visual designs;
  • graphics;
  • icons;
  • databases and database structure;
  • compilations;
  • original texts;
  • documentation;
  • algorithms and technical solutions; and
  • other proprietary materials.

Except where expressly permitted by ARMTED or applicable law, users may not copy, reproduce, distribute, sell, license, modify, create derivative works from, reverse engineer, commercially exploit or otherwise use ARMTED intellectual property without appropriate authorisation.

Nothing in this Policy or use of the ARMTED platform transfers ownership of ARMTED intellectual property to a user.

6. THIRD-PARTY INTELLECTUAL PROPERTY

ARMTED may contain materials belonging to users, businesses, manufacturers, organisations or other third parties.

Third-party trademarks, product names, photographs, descriptions, logos and other materials remain subject to the rights of their respective owners.

Their appearance on ARMTED does not necessarily mean that the relevant rights holder sponsors, endorses or is affiliated with ARMTED.

References to manufacturers, firearm models, products, businesses or other third-party names may be used for identification, informational, directory, catalogue or other lawful purposes where permitted by applicable law.

7. REPORTING INTELLECTUAL PROPERTY INFRINGEMENT

If you believe that content available through ARMTED infringes intellectual property rights that you own or are authorised to enforce, you may submit an infringement report.

Where ARMTED provides a dedicated intellectual property reporting mechanism, you should use that mechanism.

If no dedicated mechanism is available, you may submit the report to:

To allow ARMTED to assess the report efficiently, your notice should contain the information described below.

8. INFORMATION REQUIRED IN AN INFRINGEMENT NOTICE

An intellectual property infringement notice should include:

  1. Identification of the reporting person

    Your full name or, where applicable, the name of the organisation or rights holder you represent.

  2. Contact information

    Sufficient information for ARMTED to communicate with you regarding the report, such as an email address.

  3. Identification of the intellectual property right

    A sufficiently precise description of the copyright work, trademark, design, database or other intellectual property right that you claim has been infringed.

  4. Evidence of rights

    Information reasonably sufficient to demonstrate that you own the relevant rights or are authorised to act on behalf of the rights holder.

  5. Identification of the allegedly infringing content

    Information reasonably sufficient for ARMTED to locate the content.

    Where available, this should include a direct URL, listing identifier, post identifier, profile identifier or other precise reference.

  6. Explanation of the alleged infringement

    A reasonably detailed explanation of why you believe the identified content infringes the relevant intellectual property right.

  7. Territory

    Where relevant, identification of the country or territory in which the intellectual property right is protected and the infringement is alleged to occur.

  8. Good-faith statement

    A statement confirming that you have a good-faith belief that the disputed use is not authorised by the rights holder, its representative or applicable law.

  9. Accuracy and authority

    A statement confirming that the information provided in the notice is accurate and that you are the rights holder or are authorised to act on behalf of the rights holder.

  10. Signature

Where appropriate or required by applicable law, your physical or electronic signature.

ARMTED may request additional information where reasonably necessary to assess the claim.

9. INCOMPLETE OR UNCLEAR NOTICES

ARMTED may be unable to act on a report if it does not contain enough information to:

  • identify the relevant intellectual property right;
  • establish the reporter’s authority;
  • identify the allegedly infringing content;
  • understand the alleged infringement; or
  • assess the claim.

Where reasonably possible, ARMTED may ask the reporting person to provide missing or additional information.

Submission of a notice does not guarantee removal or restriction of the reported content.

10. REVIEW OF INTELLECTUAL PROPERTY REPORTS

ARMTED may review an intellectual property report together with:

  • the information provided by the reporting person;
  • the reported content;
  • information available to ARMTED;
  • information supplied by the user who published the content;
  • applicable ARMTED policies;
  • applicable law; and
  • other circumstances reasonably relevant to the claim.

ARMTED does not act as a court and is not required to resolve complex disputes concerning ownership or validity of intellectual property rights where those disputes cannot reasonably be determined through ARMTED’s platform procedures.

Where appropriate, the parties may need to resolve such disputes directly or through courts, administrative authorities or other competent bodies.

11. ACTIONS ARMTED MAY TAKE

Where ARMTED determines that action is appropriate, ARMTED may, subject to applicable law:

  • remove content;
  • disable access to content;
  • restrict the visibility of content;
  • remove particular photographs, videos or other materials;
  • remove or restrict a listing;
  • restrict particular functionality;
  • suspend publication of content while a claim is reviewed;
  • request that a user modify or remove content;
  • issue a warning;
  • restrict an account;
  • suspend an account;
  • terminate an account; or
  • take other measures reasonably appropriate to the circumstances.

ARMTED may also preserve relevant information where reasonably necessary for legal, security, dispute-resolution or compliance purposes.

12. NOTIFICATION OF THE AFFECTED USER

Where appropriate and permitted by applicable law, ARMTED may notify the user whose content has been affected by an intellectual property complaint.

The notification may include information concerning:

  • the content affected;
  • the nature of the complaint;
  • the intellectual property right asserted;
  • the action taken by ARMTED;
  • the reason for the action; and
  • available review or appeal mechanisms.

ARMTED may withhold information where disclosure is prohibited by law, would create material security or safety risks, would interfere with an investigation or where another legitimate reason justifies nondisclosure.

13. APPEALS AND COUNTER-NOTICES

If your content has been removed or restricted following an intellectual property complaint and you believe that the decision was incorrect, you may use an appeal or counter-notice mechanism made available by ARMTED.

You should explain why you believe that:

  • you own the relevant rights;
  • you have permission or a valid licence;
  • the use is permitted by applicable law;
  • the complainant has misidentified the content;
  • the complaint concerns different content; or
  • the restriction or removal was otherwise incorrect.

ARMTED may request evidence supporting your position.

Submission of an appeal or counter-notice does not guarantee restoration of the content.

14. RESTORATION OF CONTENT

ARMTED may restore content where it reasonably determines that:

  • the original complaint was unfounded;
  • sufficient evidence of authorisation has been provided;
  • the complainant withdraws the complaint;
  • applicable law requires restoration;
  • a competent authority determines that the content may lawfully be used; or
  • restoration is otherwise appropriate under the circumstances.

Restoration does not prevent ARMTED from taking subsequent action if new information becomes available.

15. REPEAT INFRINGERS

ARMTED may take escalating action against users who repeatedly infringe intellectual property rights.

Depending on the nature, seriousness, frequency and circumstances of the infringements, measures may include:

  • warnings;
  • removal of content;
  • restrictions on publishing functionality;
  • restrictions on listings;
  • temporary suspension;
  • permanent account termination; or
  • other appropriate restrictions.

ARMTED may consider factors including whether infringement was intentional, repeated, systematic or particularly serious.

ARMTED reserves the right to terminate an account following a single serious infringement where appropriate and permitted by applicable law.

16. FRAUDULENT OR ABUSIVE IP REPORTS

You must not knowingly submit false, fraudulent, misleading or abusive intellectual property complaints.

This includes attempting to use ARMTED’s intellectual property reporting mechanisms to:

  • remove lawful competing content;
  • harass another user;
  • interfere with legitimate criticism or commentary;
  • falsely claim ownership of material;
  • impersonate a rights holder;
  • suppress lawful content; or
  • otherwise misuse ARMTED’s reporting systems.

ARMTED may reject such reports and may restrict access to reporting mechanisms or take action against an ARMTED account used for abuse.

Persons submitting false claims may also be responsible for consequences provided by applicable law.

17. TRADEMARK COMPLAINTS

If you believe that content on ARMTED infringes your trademark rights, your report should identify:

  • the trademark;
  • the registration number, where applicable;
  • the jurisdiction of registration or protection;
  • the goods or services covered;
  • evidence that you own or are authorised to enforce the mark;
  • the allegedly infringing ARMTED content; and
  • why the relevant use is likely to infringe your rights.

The presence of a trademark in a listing, catalogue entry, review, discussion or other content does not automatically constitute trademark infringement.

ARMTED may consider the context and purpose of the use when assessing a complaint.

18. PRODUCT, FIREARM AND CATALOGUE CONTENT

ARMTED may provide catalogue, directory or informational functionality concerning firearms, accessories, manufacturers, models and other products.

Such functionality may include names, specifications, identifiers, descriptions, classifications, historical information, photographs or other materials derived from users, rights holders, licensed sources, public sources or other sources ARMTED is entitled to use.

Intellectual property rights may apply differently to individual components of such information.

A claim concerning catalogue content should therefore identify precisely:

  • the particular content claimed to be protected;
  • the rights asserted;
  • the basis of the claimant’s rights;
  • the specific ARMTED content alleged to infringe those rights; and
  • the territory in which protection is claimed.

A claim of ownership over a product, firearm or model name alone does not automatically establish a right to prevent all informational references to that name.

19. PHOTOGRAPHS AND VIDEOS

Users must ensure that they have sufficient rights to photographs and videos uploaded to ARMTED.

This applies regardless of whether the photograph or video depicts:

  • the user;
  • another person;
  • a firearm;
  • a product;
  • a business;
  • a shooting range;
  • an event; or
  • another subject.

Uploading media created by another person without permission may infringe copyright even where the uploading user owns the object depicted in the media.

Where appropriate, users should obtain necessary licences or permissions from photographers, videographers and other rights holders before uploading content.

20. BUSINESS PROFILES AND CLAIMED ENTITIES

ARMTED may allow businesses, organisations or other entities to claim, verify or manage profiles or directory entries.

Control over an ARMTED business profile does not automatically transfer ownership of:

  • photographs uploaded by other users;
  • user reviews;
  • user posts;
  • third-party copyrighted materials;
  • third-party trademarks; or
  • other independently protected content associated with that profile.

Intellectual property complaints concerning such materials must be assessed according to the rights applicable to the particular content.

21. NO AUTOMATIC OWNERSHIP THROUGH VERIFICATION

Verification by ARMTED of a user, business, firearm or other resource does not determine or certify ownership of intellectual property rights.

A verification badge or status does not establish that the verified person or entity owns copyright, trademark rights or other intellectual property rights in all content associated with the verified account or resource.

22. PRESERVATION AND DISCLOSURE OF INFORMATION

ARMTED may retain information relating to intellectual property complaints, counter-notices, affected content and enforcement actions where reasonably necessary for:

  • handling the relevant dispute;
  • preventing repeated infringement;
  • establishing, exercising or defending legal claims;
  • complying with legal obligations;
  • responding to competent authorities;
  • preventing abuse of ARMTED systems; or
  • maintaining appropriate enforcement records.

Information may be disclosed where required or permitted by applicable law.

Personal data associated with intellectual property procedures is processed in accordance with the ARMTED Privacy Policy.

23. LEGAL ORDERS AND AUTHORITIES

ARMTED may comply with valid court orders, administrative decisions, regulatory requirements and other legally binding requests relating to intellectual property.

Nothing in this Policy prevents a rights holder or affected user from pursuing remedies available through courts, administrative bodies or other competent authorities.

24. UNITED STATES COPYRIGHT CLAIMS

For copyright claims subject to United States law, ARMTED may provide procedures intended to comply with applicable requirements of the U.S. Digital Millennium Copyright Act (“DMCA”), including procedures concerning copyright notices and counter-notifications.

Where ARMTED publishes dedicated instructions or contact details for DMCA notices, claimants should use that process.

Additional U.S.-specific requirements may be contained in a regional supplement to this Policy.

A DMCA notice or counter-notification must satisfy the requirements imposed by applicable U.S. law in order to receive the legal treatment provided for such notices.

25. EUROPEAN UNION USERS AND ILLEGAL CONTENT REPORTING

Where applicable, intellectual property infringement may also constitute illegal content for purposes of European Union law.

ARMTED may therefore process certain intellectual property reports through mechanisms established for reporting illegal content.

Where applicable law requires ARMTED to provide reasons for particular content moderation decisions or other procedural rights, ARMTED will provide those mechanisms in accordance with applicable requirements.

The availability of an ARMTED intellectual property reporting mechanism does not prevent a person from using another legally available notice or complaint mechanism.

26. NO LEGAL DETERMINATION BY ARMTED

ARMTED’s decision to remove, restrict, restore or leave content available is a platform moderation decision.

Except where expressly required by applicable law, it does not constitute a judicial determination that:

  • infringement has occurred;
  • infringement has not occurred;
  • a particular person owns an intellectual property right;
  • an intellectual property right is valid;
  • a licence exists or does not exist; or
  • a party is legally liable.

Nothing in an ARMTED moderation decision prevents the parties from seeking determination of their rights from a competent authority.

27. CHANGES TO THIS POLICY

ARMTED may update this Policy from time to time, including because of:

  • changes to ARMTED functionality;
  • changes to intellectual property reporting procedures;
  • changes to applicable law;
  • regulatory requirements;
  • new types of content or services; or
  • changes to ARMTED’s enforcement procedures.

The current version and effective date will be displayed at the beginning of this Policy.

28. RELATIONSHIP WITH OTHER ARMTED POLICIES

This Policy should be read together with other applicable ARMTED documents, including:

  • Terms of Service;
  • Community Guidelines;
  • Listing Policy;
  • Firearms Listing Policy;
  • Privacy Policy;
  • ARMTED Partners / Business Terms; and
  • applicable regional supplements.

If content violates both intellectual property rights and another ARMTED rule, ARMTED may take action under any applicable policy.
